FAQ


Is discharging a firearm in the township legal?

Yes, discharging a firearm in the township is legal as long as it is done in a safe manner and during a reasonable time. It is very important to have an appropriate backstop.

Is there a noise ordinance in the township?

Yes, the Township adopted a resolution to prohibit unreasonable noise on real property in the unincorporated territory of Clearcreek Township as permitted by Ohio Revised Code Chapters 504 and 505. Per the resolution, no person shall make, generate, or allow a loud or raucous noise in the unincorporated territory of the Township in such a manner as to disturb the peace and quiet of surrounding properties, or to be otherwise detrimental to any individual’s life and health. In the event noises are alleged to be public nuisances, an officer will determine whether they constitute a violation, bearing in mind the necessity, frequency, duration, reasonableness, locality, time of occurrence, and noise level.

 Exemptions:

Agriculture and Business:

This ordinance shall not apply to noises caused by a farm or business operation that are carried out in an area properly zoned for that activity, provided the activity causing the noise is necessary to farm or business operations.

 

Other Exemptions:

This ordinance shall not apply to the following:

  • Sounds emanating from a warning or alarm device, safety signal, or emergency pressure release valve.
  • Sounds emanating from an emergency vehicle while responding to an emergency call or otherwise acting in response to an emergency.
  • Sounds emanating from government-sponsored or authorized special events.
  • Sounds resulting from the normal use of schools, athletic fields, parks, and churches.
  • Sounds emanating from setting off fireworks during any State-recognized fireworks days; provided, fireworks-related activities cease by 11:00 PM.
  • Sounds generated by manufacturing equipment, tools, or motor vehicles used for lawful activities.

 

Resolution 5605 – Revised Noise Ordinance

Is there a barking dog ordinance?

Yes, under the authority of Ohio Revised Code Section 955.221 (B) (2), the Township adopted a resolution that finds dogs which howl, bark, or yelp creating unreasonably loud and disturbing noises of such character, intensity, or duration as to disturb the peace and quiet of the Township are a public nuisance.

In the event a barking dog is alleged to be a public nuisance, an officer will determine whether the barking constitutes a violation, bearing in mind the frequency, duration, reasonableness, locality, time of occurrence, and noise level.

Are solicitors/transient vendors permitted to sell goods or services in the township?

Yes, solicitors/transient vendors are permitted to sell goods and services as long as they have obtained a permit through the Clearcreek Township Police Department.  Permits are kept on file at the Clearcreek Township building.
